Dutch regulator hands warning to Postcode Lottery over celebrity ad

The Dutch gaming regulator has issued a warning to the National Postcode Lottery (NPL) for using a well-known Dutch person in its advertisements.

The Gaming Authority (Ksa) said the person was featured from Oct. 2021 to March 2022 in TV and online commercials for NPL’s Deal or no Deal lottery game.?

The lottery, which is considered a less risky game of chance, is able to use celebrities as long as they investigate the reach of that person amongst minors and young adults. If this is substantial, they may not be used.

Lottery failed to investigate

In this particular case, the lottery did not investigate until the regulator asked. The Ksa established that the role model had substantial reach amongst young people.

The Ksa could have fined the NPL for these violations, but left it at a warning. The reason for this is the discussion about the amendment of the regulations during the procedure. Among other things, this was about what should be understood by the term ‘role model’. This concept has been further elaborated in the regulations from 30 June 2022.

The Ksa imposed a ban on role models in online gambling from June. For the most part, it said this ban has been well respected by online gambling firms.?

The regulator has also put the country’s online gambling regulators on notice for advertising during the upcoming World Cup in Qatar. It has said it doesn’t want to see a “tidal wave” of advertisements.?
